    Can I be fired for claiming workers’ compensation?

    In an already uncertain time, when you should be focussing on your rehabilitation and recovery, worrying about being sacked for claiming workers’ compensation is a common fear.

    In Queensland workers are protected by the Workers’ Compensation and Rehabilitation Act 2003 (QLD) – employers can NOT fire workers within 12 months of the injury or illness. This should create some peace of mind and give workers the security in knowing they can not be sacked for claiming workers’ compensation.

    Employers who do not honour this rule face serious penalties.
