Meet KathrynThere are various laws that govern how a personal injury lawsuit is handled in Queensland. How you are injured will determine what laws apply and what steps need to be followed.
Motor vehicle accidents are governed by laws including the Motor Accident Insurance Act 1994 (Qld) which sets out a series of steps that must be taken before you can file documents in a Court to start court proceedings. The purpose of the pre court procedures is to set out a process that is followed by every claimant and allows the parties to attempt to settle without the need to involve the Courts. The pre court procedures set out time limits, forms and processes that must be followed to have a valid claim.
WorkCover claims are governed by laws including the Workers’ Compensation and Rehabilitation Act 2003 (Qld). This Act also sets out pre court procedures that must be followed. By following the pre court time limits, forms and procedures you ensure your claim is valid and protected. The work cover pre court procedures also dictate that the parties must attempt to settle the claim before Court proceedings and that process can be initiated.
Public liability claims are governed by laws including the Personal Injuries Proceedings Act 2002 (Qld). This Act sets out pre court timelines, forms and procedures that must be followed to ensure you have a valid claim. The pre court procedures are designed to assist in gathering evidence and reaching a settlement in a claim before needing to involve the Courts and the court process.
A very small percentage of claims are not able to be resolved in the pre court process and it then becomes necessary to file Court Proceedings in the Courts to work towards a trial. The Courts are also governed by a series of laws that set out steps that need to be taken as you work towards trial and many claims are settled during this time before a trial is commenced.
