Meet KathrynAs a young inexperienced worker, who could have blamed Mia* if she just accepted that nothing wrong happened at work, after all, this is what her employer and the insurer were telling her. Thankfully Mia called the team at Trilby Misso for some advice around a worker’s compensation claim.
The employee/employer relationship is one of trust, this is especially true for a young worker just recently entering the workforce. To have that trust broken is devastating and can have serious ongoing psychological impact. In traumatic circumstances, Mia was sexually harassed by her employer, causing psychological injury to the young worker.
Having the claim accepted was the first hurdle for the team at Trilby Misso. An appeal was prepared against the insurer’s decision to reject the claim. The tribunal considered the legal team’s submissions and overturned the rejection and the claim was accepted, this meant Mia could now access funding for her much needed medical treatment.
Once Mia’s medical condition had stabilised she was offered a Lump Sum offer of $17,392. Her legal team advised her that it was inadequate and that she should not accept the offer. They prepared her Common Law claim, gathered evidence about the harassment, as well as organising independent medical reports. Trilby Misso negotiated on her behalf and secured a settlement of $137,500, almost 8 times what she was offered by the insurer.
Given the circumstances of the event and the nature of the injury, it was incredibly important that the team at Trilby Misso act with absolute sensitivity. They were able to work with Mia to make sure she felt secure and her interests were protected and she received the best possible settlement for her future.
