Persistence, strategy and negotiation skills were needed to secure fair compensation for Jacob*.

Jacob unfortunately sustained serious injuries as the passenger of a motor vehicle accident involved with a truck. The first legal hurdle was establishing who was at fault, this was not clear and involved the team at Trilby Misso examining the evidence and pursuing a claim against both insurers. Ultimately the driver of the truck was deemed at fault and the claim against his insurer continued.

The insurer in this instance was not easy to deal with and made negotiations very difficult Their offers to settle did not take into consideration the medical evidence and at one stage their offers were reducing in value instead of increasing.

Jacob’s legal team assessed that they had to add pressure to the insurer to be taken seriously in this case. They knew that filing papers in the Court and taking steps towards a trial would be the best strategy. After Court documents were filed, and the insurer engaged their own lawyers, settlement talks recommenced. A settlement of double what was initially being offered was reached.

Jacob felt protected by his legal team fighting hard for him and not being put off or giving up because of a difficult insurer.
