    Many people think making a Total and Permanent Disability Claim is as simple as completing and submitting a form to the insurer. With large sums of money at stake it isn’t unusual for insurers to find reasons to reject a claim.

    While it was clear to Derek he had a permanent disability, having lost his foot, a successful claim required satisfying all the terms of the insurance policy. In this case the insurer was attempting to avoid payment by relying on a “pre-existing injury” exclusion in the policy. They then carefully prepared submissions addressing why the terms of the policy were satisfied and the claim should be paid.
