Can I Be Fired While on WorkCover in Queensland?

June 16, 2026

No, an employer cannot dismiss you simply because you have made a WorkCover claim or are receiving workers’ compensation benefits. If you’ve been injured at work, you may be entitled to make a WorkCover claim or pursue a workplace injury claim. Queensland workers have legal protections while recovering from a work-related injury or illness.

What Protection Do Workers Have While on WorkCover?

Queensland’s workers’ compensation system is designed to protect workers who suffer an injury during the course of their employment. Employers generally cannot take adverse action against an employee simply because they reported an injury or lodged a WorkCover claim.

These protections may apply whether the injury occurred:

  • In an office
  • On a construction site
  • While driving for work
  • During manual labour
  • While travelling for work

If you’ve suffered an injury at work and are unsure about your rights, you can learn more about the claims process through our WorkCover Claim page.

Can My Employer Ever End My Employment?

Being on WorkCover does not guarantee that employment will continue indefinitely.

Employment may still end for lawful reasons unrelated to the workers’ compensation claim itself, including:

  • Genuine redundancy
  • Business closure
  • Serious misconduct
  • Circumstances where a worker can no longer perform the inherent requirements of the role

Every situation is different and depends on the individual facts.

What Should I Do If I’m Concerned About My Job?

If you’ve suffered a workplace injury:

  1. Report the injury as soon as possible.
  2. Seek medical treatment.
  3. Obtain and retain medical certificates.
  4. Keep records of communications with your employer.
  5. Follow any suitable return-to-work arrangements where appropriate.

Workers who experience difficulties after reporting an injury should keep detailed records of all communications with their employer and seek advice about their rights as soon as possible.
