You can still make a WorkCover claim even if your employer does not report your workplace injury. Injured workers can generally lodge a WorkCover claim directly, and may also have rights through a workplace injury claim depending on the circumstances.

Does My Employer Have Reporting Obligations?

Yes. Queensland employers have obligations to keep workplace injury records and report certain incidents. However, an employer’s failure to meet those obligations does not automatically prevent an injured worker from making a claim.

What Should I Do If My Injury Hasn’t Been Reported?

If you’ve been injured at work:

  1. Notify your employer as soon as possible.
  2. Seek medical treatment.
  3. Obtain a medical certificate.
  4. Keep copies of emails, messages and reports.
  5. Record dates and details of conversations.

Keeping detailed records can be valuable if there is later disagreement about what occurred.

Can I Lodge a WorkCover Claim Myself?

Yes. Workers can generally lodge a claim directly with WorkCover Queensland. You do not need your employer’s permission to start the process.

If you haven’t yet seen a doctor, obtaining medical evidence is often an important step when making a WorkCover claim, as it helps document your injury and support the claims process.
